These are the General Terms and Conditions of Brasss & Haarlem Hotel Suites, registered with the Chamber of Commerce under number 34065583, registered at the address Oudeweg 8G, 2031 CC in Haarlem, VAT number NL809430502B01. These terms and conditions apply to all services of Brasss & Haarlem Hotel Suites and to any use of the websites www.brasss-hotelsuites.nl and www.haarlem-hotelsuites.nl and underlying web pages (hereinafter: the 'website').

By using the website, you agree to be bound by these General Terms and Conditions. Brasss & Haarlem Hotel Suites reserves the right to amend these General Terms and Conditions at any time without prior notice. It is advisable to review these General Terms and Conditions (again) upon repeated use.

Reservations and services

You can reserve a suite/apartment in one of our hotels via the website. All reservations must be guaranteed by means of a credit card valid on the date of arrival. Non-guaranteed reservations will not be accepted.

For bookings made via the website, the rates applicable at that time apply. Brasss & Haarlem Hotel Suites is entitled at all times to refuse to accept or execute a reservation, or to attach additional conditions to the acceptance or execution of a reservation.

You must use the services of Brasss & Haarlem Hotel Suites in accordance with applicable law, these General Terms and Conditions, generally accepted standards of decency, and reasonable instructions from our hotels, as published on the website or provided at the hotel. It is therefore not permitted to use the services for unlawful purposes, in a manner that could harm the rights and/or interests of third parties, or that, in the opinion of the staff of Brasss & Haarlem Hotel Suites, could in any way harm our hotels. If you act in violation of the foregoing, our hotels reserve the right to refuse further service to you. You are liable for all damages and expenses incurred by Brasss & Haarlem Hotel Suites as a result of the breach of this provision, without the need for a prior claim or notice of default.

Cancellation and termination

Cancellation or modification of a reservation based on the standard rate must take place no later than 23:59 (local time at the hotel location) one day prior to the day of arrival. Otherwise, the cost for one night, including taxes, will be charged unless otherwise agreed (e.g., for short-long stays). When a guest has booked the non-refundable rate, the full amount will be charged at all times.

Since the services of Brasss & Haarlem Hotel Suites relate to accommodation and/or recreational services taking place within a specific period or on a specific date and/or time, statutory regulations granting the customer the right to cancel a distance contract without giving reasons and within a specific period do not apply to the agreement concluded via the Website, nor to the services.

Payment

The rates listed on the website include VAT and any other surcharges, unless otherwise indicated. Brasss & Haarlem Hotel Suites reserves the right to change these rates without prior notice for reasons deemed appropriate.

In the event of failure to make (timely) payment, you will be in default, without the need for a prior claim or notice of default. If, despite the claim or notice of default, you still fail to pay, Brasss & Haarlem Hotel Suites has the right to transfer the claim to a third party.

Intellectual property rights relating to the website

You acknowledge and agree that the website contains material protected by copyright. In no circumstances shall the total liability of Brasss & Haarlem Hotel Suites for direct damage, of any nature whatsoever, exceed the amount of €500.

Only the following damage is considered direct damage:

Damage to property;
Reasonable costs associated with the assessment of the cause and extent of the damage, insofar as this assessment relates to direct damage, as described in these General Terms and Conditions;
Reasonable costs associated with preventing or limiting the damage, to the extent that you can prove that these costs have led to a reduction of direct damage, as described in these General Terms and Conditions.

Brasss & Haarlem Hotel Suites' liability for damages other than direct damages ('indirect damages'), including but not limited to moral or consequential damages, loss of profits, lost opportunities, loss of information, expenses incurred in connection with this website or a website linked to it, or for damages arising from the use or inability to use the website, software algorithms, or linked websites due to interruptions, defects, delays in operation or transmission, computer viruses, or line or system failures, is expressly excluded.

The limitations referred to in the preceding paragraphs of this article shall cease to apply if and to the extent that the damage is the result of intentional or conscious recklessness on the part of Brasss & Haarlem Hotel Suites or its managers ('own actions').

A condition for the entitlement to compensation is that you report the damage to Brasss & Haarlem Hotel Suites as soon as possible after it occurs.
